PROTEGENDO QUEM TE PROTEGE: UMA BREVE DISCUSSÃO ACERCA DA PRERROGATIVA DA INAMOVIBILIDADE DA AUTORIDADE POLICIAL

Resumo

O presente artigo apresenta uma discussão acerca da carreira do delegado de polícia e a ausência da prerrogativa constitucional da inamovibilidade a esses profissionais de segurança pública, os quais podem ser removidos para outra delegacia ou cidade a critério da administração superior da sua instituição. O texto tem por finalidade analisar, ainda que de forma breve, o instituto da inamovibilidade, quais carreiras a contemplam, assim como os argumentos que apontam para a imperativa necessidade de concessão da prerrogativa a esses operadores jurídicos. Para a realização do trabalho foi efetuada pesquisa bibliográfica e jurisprudencial acerca do assunto, com referências inclusive à legislação atinente ao Estado de Santa Catarina, local em que o estudo foi desenvolvido. Por meio da pesquisa foi possível concluir que o delegado de polícia precisa fazer jus, assim como outras carreiras jurídicas, à garantia da inamovibilidade, de modo que esteja protegido de pressões externas e remoções ilegais, sem fundamento legal e ligadas a meros interesses políticos, por exemplo. Enfim, é imprescindível garantir independência, imparcialidade e eficácia nas investigações criminais conduzidas pela autoridade policial, em observância aos princípios administrativos da supremacia do interesse público e da eficiência.

This article presents a discussion about the career of a chief of police and the absence of the constitutional prerogative of irremovability. These government employees can be transferred to other police stations or cities at the discretion of the institution higher administration which they belong. The purpose of the text is to analyze, although briefly, the institute of irremovability, which careers contemplate it and the arguments leading to the necessity of granting the prerogative to these professionals. Bibliographical and doctrinal research on the subject were employed for the accomplishment of the work with references even to the legislation concerning the State of Santa Catarina, where the study is developed. With the research one can consider that the chief of police must justify, as well as other legal careers, the guarantee of irremovability so that he or she would be protected from external pressures and illegal transferences. Finally, it is imperative to ensure independence, impartiality and effectiveness in criminal investigations conducted by the police authority, in accordance with the administrative principles of the supremacy of public interest and efficiency.
