MANIPULAÇÃO QUE DESTRÓI O SENSO DE REALIDADE DA VÍTIMA: ASPECTOS JURÍDICOS E PSICOLÓGICOS SOBRE O FENÔMENO GASLIGHTING

Resumo

O presente artigo versa sobre o fenômeno do gaslighting, espécie de violência psicológica contra a mulher, frequentemente praticada e, ao mesmo tempo, pouco conceituada e estudada. Inicialmente, é definido o que possa ser considerado como prática de gaslighting e de que forma precisa ser trabalhada na esfera policial, onde visa apurar o cometimento desta forma de violência psíquica consubstanciada em âmbito doméstico, assim como enquadrar tal prática no tipo penal adequado. Com o advento da Lei nº 14.188/2021, que incluiu o artigo 147-B ao Código Penal, foi finalmente tornada crime a violência psicológica contra a mulher, o que evidencia a relevância do tema. Nos delitos dessa natureza os vestígios materiais são quase sempre diáfanos e sutis. Portanto, é imprescindível que os atores estatais, em especial os órgãos e as forças policiais, disponham da habilidade adequada para sua percepção e trato, a fim de procederem a devida persecução penal ante o cometimento do gaslighting.

This article deals with the phenomenon of gaslighting, a kind of psychological violence against women that is often practiced but not studied. Initially there is the definition of what can be considered as a practice of gaslighting. Then, how should the police investigate this form of psychological violence for it leaves very subtle material evidence and it is essential that the police forces have the appropriate ability to perceive and collect this evidence. And lastly, how could the practice of gaslighting be seen through the penal code with the enactment of Law 14.188/2021, which included article 147-B to the mentioned code, and psychological violence against women was finally criminalized.
