ORGANIZAÇÕES CRIMINOSAS E O INSTITUTO DA INFILTRAÇÃO DE AGENTES DE ACORDO COM A LEI Nº 12.850/13

Resumo

O presente artigo tem por escopo analisar o instituto da infiltração de agentes frente ao avanço da criminalidade organizada, visando prevenir e combater eficazmente a delinquência moderna. O trabalho foi produzido a partir do método de abordagem dedutivo, sendo que, com relação aos procedimentos técnicos, baseou-se em pesquisa bibliográfica por meio de análise de livros, revistas, trabalhos publicados na web e outros artigos científicos que abordam o tema proposto. O estudo pretende demonstrar a existência e os aspectos históricos do crime organizado no Brasil e no mundo, bem como analisar a evolução e a construção teórica do conceito de organização criminosa adotado no País. A pesquisa visa, ainda, analisar os aspectos gerais e conceituais do instituto da infiltração de agentes, especialmente de acordo com a nova Lei do Crime Organizado. Por fim, conclui pela importância da adoção de técnicas especiais de investigações, principalmente da infiltração de agentes no combate à criminalidade organizada atual.

The purpose of this article is to analyze the institute of the infiltration of agents when dealing with the advance of organized crime, in order to effectively prevent and combat modern delinquency. The work was produced using the deductive approach method, in bibliographic research, through the analysis of books, journals, works published on the web and other scientific articles that approach the proposed theme. The study aims to demonstrate the existence and historical aspects of organized crime in Brazil and in the world, as well as to analyze the evolution and theoretical construction of the concept of criminal organization adopted in the country. The research also aims to analyze the general and conceptual aspects of the institute of infiltration of agents, especially according to the new Organized Crime Law. Finally, it concludes by the importance of adopting special techniques of investigations, mainly the infiltration of agents, in the fight against the current organized crime.
