A INVESTIGAÇÃO CRIMINAL NA ERA DAS FAKE NEWS

Resumo

Resumo: A presente pesquisa tem o propósito de analisar em que medida a divulgação de notícias falsas, as denominadas fake news, interfere no desenvolvimento da investigação criminal, atividade-fim da Polícia Judiciária. O trabalho em apreço foi desenvolvido a partir de pesquisas bibliográficas sobre o assunto. Intenciona demonstrar como o avanço digital e a consequente criação das mídias sociais modificaram o comportamento dos indivíduos e, em consequência, as representações sociais, alterando a maneira de obter e divulgar as informações. Além disso, expender sobre o limite que há entre o direito constitucional da liberdade de informação e a alteração da verdade dos fatos quando da divulgação de supostas notícias, bem como a colisão existente entre a liberdade de informação e os direitos da personalidade. Ainda, discorrer acerca da ausência de lei, no Brasil, que tipifique criminalmente a conduta de divulgação de notícias falsas e como se posicionam outros países sobre o assunto. Por último, evidenciar os desafios diários que os policiais integrantes da Polícia Judiciária enfrentam no desempenho de suas atividades, face à atual e contraproducente realidade quanto à divulgação de informações. Verificou-se que o uso da expertise dos policiais, a realização de filtragem das notícias, a utilização de inteligência artificial e a participação da própria sociedade, se consciente e atenta, poderão fazer frente a este descomedido e multifacetado problema, conhecido atualmente como fake news

Abstract: The present research aims to analyze the extent to which the dissemination of false news, the so-called fake news, interferes in the development of the criminal investigation, a core activity of the Judiciary Police. This work was developed from bibliographic research about the subject. It intends to demonstrate how the digital advance and the consequent creation of social media have modified the behavior of individuals and, consequently, social representations, changing the way of obtaining and disseminating information. In addition, it expounds on the limit between the constitutional right to freedom of information and the alteration of the truth of the facts when the supposed news is divulged, as well as the existing collision between the freedom of information and the personality rights. Also, discuss the absence of law in Brazil that criminally typifies the conduct of spreading fake news and how other countries position themselves on the subject. Finally, to highlight the daily challenges that the police officers from the Judiciary Police face in the performance of their activities, given the current and counterproductive reality regarding the dissemination of information. It was found that the use of police expertise, filtering of the news, the use of artificial intelligence and the participation of society itself, if conscious and attentive, will be able to face this inordinate and multifaceted problem, currently known as fake news.
