O PRINCÍPIO DE PRESUNÇÃO DE INOCÊNCIA E A DIVULGAÇÃO DE INVESTIGAÇÕES POLICIAIS À MÍDIA

Resumo: O presente artigo realiza uma análise acerca da preservação dos direitos humanos na divulgação de investigações policiais à mídia. Entre os direitos e garantias fundamentais dispostos na Constituição Federal de 1988, está o princípio da presunção de inocência. A investigação criminal não afasta a presunção de inocência do investigado e pode ser fonte de informação para a mídia. Buscou-se discutir os princípios a serem observados por delegado(a)s e agentes da Autoridade Policial na publicidade de investigações visando a resolução de possíveis conflitos existentes entre previsões constitucionais e a divulgação de informações sobre investigados. Por fim, refletiu-se sobre como a Polícia Civil do Estado de Santa Catarina regulamentou a divulgação dos resultados dos trabalhos da instituição atendendo à presunção de inocência do investigado, na Resolução n. 12/GAB/DGPC/SSP/2018, no ano de 2018, abordando, ainda, breves considerações acerca da nova Lei de Abuso de Autoridade.

Abstract: This article analyzes the preservation of human rights in disseminating police investigations to the media. Among the fundamental rights and guarantees provided in the Federal Constitution of 1988 is the principle of presumption of innocence. The criminal investigation does not remove the presumption of innocence of the investigated and can be a source of information for the media. We sought to discuss the principles to be observed by delegates and agents of the police authority in the publicity of investigations aimed at resolving conflicts between constitutional provisions and disseminating information about investigated persons. Finally, it was reflected on how the Santa Catarina Civil Police regulated the dissemination of the results of the institution's work taking into account the presumption of innocence of the investigated, in Resolution n. 12/GAB/DGPC/SSP/2018, in 2018, also presenting brief considerations about the new Law on Abuse of Authority.
